REQUIRED DEPOSITS:
These are confirming/damage deposits and do not apply
toward rental fees and are due in our office before reservation is
confirmed. The deposit, which is $500.00 on all houseboats, is a
non-refundable reservation deposit that converts to a damage deposit
when you arrive for your trip and refundable to you at the end of
your charter as long as the boat is returned on time and in the
same condition as checked out. There will be a charge of $100.00
per hour (minimum $100.00) on any boat that is returned late. There
will be an additional $100.00 or more cleaning fee for any boat that
is not returned in the same condition as when it was boarded. If the boat
is not used and the reservation is canceled all sums paid will be retained as liquidated damages.
Deposits for use of the ski boats or kayaks are described
under watertoys.
PAYMENT OF RENTAL: Can be
made in either of two ways:
1. In four equal monthly payments of 1/4th
of the rental amount starting four (4) months before departure
date and each month thereafter until paid in full
. -OR-
2. Full payment less a five percent (5%) cash discount
four months before departure date.
CHARGES: will be made for
damaged boats, props and other lost/damaged items. All items
will be inventoried by the contract signer and marina personal.
HOUSEBOAT CHARTER AGREEMENTS: are to
be signed by an adult, age 25 or older, prior to the time
the boat is picked up by the charter.

CANCELLATION POLICY:
1.
You have a legal right under federal law to cancel the
transaction designated above, without costs, within seven (7)
calendar days after the date you booked the reservation.
If you cancel this agreement Lake Roosevelt Vacations,
Inc. must refund your money within twenty (20) calendar
days of receiving your notice to cancel.
If you decide to cancel or rescind the transaction designated
above, you may do so by notifying Lake Roosevelt Vacations,
Inc., in writing at the address shown on the front side
of your agreement. You may use any written statement that
is signed and dated by you and states your intention to
cancel. Keep one copy of the notice no matter how you notify
Lake Roosevelt Vacations, Inc. because it contains important
information about your rights.
If you cancel by mail, fax or telegram, you must send the
notice no later than midnight of the third business day
following the latest of the events listed above. If you
send or deliver your written notice to cancel some other
way, it must be delivered to the above address no later
than that time.
2. If cancellation notice is received more than
seven (7) calendar days after confirmation but at least 119
days prior to departure, there will be a forfeiture of all
monies received, including deposit.
3. In the event you fail to make timely payments
as required herein, Lake Roosevelt Vacations, Inc. may re-charter
the houseboat and retain all sums paid as liquidated damages.
In addition, should Lake Roosevelt Vacations, Inc. he unsuccessful
in re-chartering the houseboat you will be liable for the
full charter fee.
4. This contract may be transferred any time prior
to departure upon written approval of Lake Roosevelt Inc.
If you must reschedule your vacation during the same year,
there will be a $100.00 facilitation fee charged up to 120
days prior to your trip. Any rescheduling request after
this time will be treated as a cancellation. We regret that
we cannot make exceptions for personal emergencies as a
cause for cancellation.

SOME STANDARD POLICIES:
We reserve the right to change equipment, or cancel any trip
at any time for any reason (in our best judgment concerning
weather, safety, etc.) if a trip is canceled and alternate
arrangements are not satisfactory, fares or deposits will
be refunded. We also reserve the right to refuse use of equipment,
facilities, etc., if the renter or customer, in our judgment,
is ill or otherwise in a situation which might affect his
own or the safety of others. We also reserve the right to
call in rented boats improperly or unsafely handled and retain
all moneys paid as liquidated damages.
BOAT SAFETY FEATURES: All
boats contain safety equipment such as fire extinguishers,
life preservers, anchors and/or stakes (houseboats only),
sound device, paddle (powerboats) and night light as required
by the United States Coast Guard.
DAMAGE WAIVER: Optional
waiver of liability, limiting customer liability to $500.00 in
the event boat is accidentally damaged, may be purchased for
$25.00 per day for SuperCruisers with and without hot tubs,
$35.00 per day for SuperCruiser Elites and $20.00 per day for
small craft. This waiver shall not apply to intentional
conduct or activities not covered by insurance of Lake
Roosevelt Vacations, Inc.
PET POLICY: We strongly
advise against bringing pets on the houseboats. There will
be an extra $25.00 charge required and will be limited to
cats and small dogs. This policy excludes seeing eye dogs.
HOUSEBOAT CAPACITY: is
limited to 12 persons plus the charterer. Violation will
result in loss of deposit and may also result in the boat
being called in or recovered. You will be responsible for: all
costs and expenses incurred in the event a boat is called in
or recovered.
ATTORNEYS FEES: If legal
counsel is sought or any legal action or other proceeding
is brought for the enforcement of this agreement, or because
of any alleged dispute, breach, default or misrepresentation
in connection with any of the provisions of this agreement,
the successfully or prevailing party or parties shall be entitled
to recover reasonable attorney's fees and other costs incurred,
in addition to any other relief to which it may be entitled.
INTERPRETATION: This agreement
shall be governed by the laws of the State of Washington.
Venue for any action brought here under shall be in Ferry County, Washington.
ARBITRATION: Any dispute or controversy
arising out of or relating to this Agreement or any breach hereof
(“Arbitrable Claims”) shall be determined and settled by arbitration
to be held in Spokane, Washington in accordance with the commercial
arbitration rules of the American Arbitration Association then in effect.
An award rendered in any such arbitration shall be final and binding in
all aspects upon the parties, and shall be the exclusive remedy for all
Arbitrable Claims. Judgment may be rendered upon the award by the
courts of the State of Washington and the parties consent to jurisdiction
of such courts. Notwithstanding the foregoing, injunctive relief and
other equitable remedies may be sought in the state court located
in Ferry County, Washington or the federal district court located
in Spokane County, Washington. The Parties hereto hereby waive any
rights they may have to trial by Judge or Jury in regard to Arbitrable
claims.

WE ARE NOT RESPONSIBLE
FOR LOSS OF RUNNING TIME DUE TO EQUIPMENT FAILURE, WEATHER,
ILLNESS, ACCIDENTS OR CHANGES IN PLANS.
